Validity of
the above Universities
Validity of
the above Universities may be judged by examining the provisions
of the UGC Act, 1956 (No.3 of 1956) which has been passed by the
parliament with a view to make provision for for co-ordination and
determination of standards in Universities in India. Sction "2(f)
-
"University" means a University established or incorporated
by or under the a Central Act, A Provincial Act or a State Act.
and includes any Institution as may in consultation with the University
concerned be recognised by the commission in accordance with the
regulation made in this behalf under this Act."
Validity of
Degrees
Section 22 of the UGC Act -
(1). " The right of conferring or granting degrees shall be
executed only by a University established or incorporated by or
under the a Central Act, A Provincial Act or a State Act or an Institution
deemed to be a University under section 3 or an institution specially
empowered by an Act of parliament to grant degrees
(2) save as provided in sub-section (1), no person or authority
shall confer, or grant, or hold himself or itself out as entitled
to confer or grant, any degree.
(3) For the purposes of this section, "degree" means any
, such degree as may, with the previous approval of the Central
Government, be specified in this behalf by the commission by notification
in the official gazette.
Position of
Affiliation of colleges by above universities.
The above said Act of 2002 of this state provides that the above
Universities cannot affiliate any college nor give any franchise
to any Institution. They can however, establish off-campus center,
off-shore campus, study centre only with the prior consultation
with this Commission. Campuses/ Study Centers already in existence
on 17-03- 2004, ie, the date in which the abovesaid Act is amended
by these 37 universities are being examined by this commission as
provided in the above said Act and during this period of examination,
these are permitted to continue in this interest of students.
